Practice

David focuses his practice in the areas of bankruptcy, financial restructuring, creditor's rights matters and general commercial litigation. He has represented debtors and creditors in complex bankruptcy matters including commercial loan recovery and workouts, asset recovery, and debt collection including cases under Chapters 7 and 11 of the Bankruptcy Code.

Recent Experience

  • Structured and filed an emergency Chapter 11 petition on behalf of a real estate holding company and commenced a related adversary proceeding to enjoin an action against the principal;
  • Represented several debtors in distressed situations and throughout court restructuring;
  • Represented owner of stolen antique violin in replevin action;
  • Represented large collection agency in multiple actions involving the Fair Debt Collection Practices Act and the automatic stay;
  • Represented an aircraft financing party in a Chapter 11 matter;
  • Represented a warehouse and logistics provider in the bankruptcy of a national retailer;
  • Represented an ad hoc committee of trade creditors and an investment fund in connection with its purchase of approximately $15 million of bankruptcy claims.
