Equipment Leasing and Financing

Our attorneys have a wide range of experience and capability in representing lessors, lessees, lenders, and vendors in structuring, negotiating, conducting due diligence, and documenting equipment leasing and financing transactions.

We structure, negotiate, and close equipment leasing and financing transactions of various sizes, including a diverse range of equipment such as computers, office equipment, transportation equipment, containers, trucks, and trailers.

Our practice group has extensive experience representing clients in the purchase and sale of lease portfolios, assignment and assumption of lease agreements, the remarketing of equipment at the end of a lease term, and in default, workout, and bankruptcy scenarios.

We utilize the broad range of legal resources available to our firm, including attorneys from our Banking and Financial Institutions, Bankruptcy, Business Transactions, Litigation, Mergers and Acquisitions, and Tax Planning and Advocacy Practice Groups.

Our attorneys have acted as counsel in the following transactions and matters: 

  • Represented lessor in the sale of its municipal lease portfolio to a national banking institution;
  • Represented lessor in the Western District of New York Bankruptcy Court in obtaining possession of leased equipment from the chapter 7 Trustee;
  • Negotiated, on behalf of lessor and lender, the terms and conditions of an assignment and assumption of agreement with purchaser of lessee's assets.
